Fly Posting

What is fly posting?

Fly-posting is the illegal pasting of unapproved advertising posters, stickers and signs for commercial interests.

Why is it a problem?

We have a statutory duty to keep the Borough clean. Fly posting is unsightly and spoils the environment. If it is not removed, the posters rot so look unsightly and cause litter. It also means businesses involved are gaining an unfair advantage over law abiding competitors by not paying for advertising space.

What can be done about fly posting?

The Council, with the enactment of the Anti Social Behaviour Act 2003 can issue £50 penalty charge notices on people who fly post.

Fly Posting Policy

Any form of fly-posting (that is, displaying an advertisement without consent) is an offence which is immediately open to prosecution, or to the removal or obliteration of any fly-posting material.

In the case of a placard or poster, if the material identifies the advertiser displaying it, the Council must give two days written notice under the Town and Country Planning (Control of Advertisements) Regulations 1992 SI 666, Town and Country Planning Act 1990 (as amended) requiring its removal and advising of the Council's intention, if not done, to remove or obliterate it and recover the costs incurred in undertaking these works. This advance notice gives the advertiser the opportunity to contest the Council's proposed actions but if the advertiser is not identified a placard or poster may be immediately removed or obliterated.

With the enactment of the ASBA 2003 the local authority can issue £50 penalty charge notices on those who commit the offence of fly-posting.
