Keeping Animals

We have developed a number of byelaws under Section 81 of the Public Health Act 1936 to prevent keeping of animals that are prejudicial to health. They are:

  1. No person shall keep any swine within 100 feet of a home unless the place in which they are kept is in as clean a condition as is reasonably practicable.
  2. No person shall keep any swine or deposit any swine dung on any place within 50 feet of a dwelling house.

This byelaw shall not apply:

  1. Where the place on which swine are kept or the dung is deposited is not within the same curtilage as the home and it was being lawfully used for that purpose at the time when the home was built and has been continuously used since then
  2. For a period of 12 months from the date hereof where:
  1. Any person who keeps a horse, ass, mule or donkey or any cattle or swine in a building or structure which is within 50 feet of any home other than that which they occupy themselves shall provide in connection with that building or structure:

Penalties

  1. Every person who offends against any of the these byelaws shall be liable on summary conviction to a fine set at level 2 on the standard scale and in the case of a continuing offence to a fine of £5 per day for each day during which the offence continues after conviction therefore.
